Welcome to BeyondFrames Studio. By visiting our website or placing an order through it, you agree to be bound by the Terms of Service below. Please read them carefully before using our service.

1. ABOUT OUR SERVICE

BeyondFrames Studio is a custom portrait art service that turns photographs of people and pets into timeless portrait artwork. What we provide:

  • Custom digital portrait files delivered by email
  • Premium gallery-wrapped canvas prints, produced through our network of professional print partners
  • A free watermarked preview before any payment is needed
  • A human quality check on every order

2. ELIGIBILITY AND ACCOUNTS

2.1 Age Requirement

To place an order or create an account with BeyondFrames Studio, you must be at least 18 years old, or have permission from a parent or legal guardian.

2.2 Account Registration

When you register an account, you agree to give accurate and complete information. You are responsible for keeping your login details safe and for all activity carried out under your account.

2.3 Account Termination by You

You can close your account whenever you like by reaching out to our support team. Orders that are pending or already completed are not affected.

3. ORDERING AND FULFILLMENT

3.1 Order Process

To order, upload a reference photograph, choose a portrait style, and submit your request. A free watermarked preview is then created for you to review before any payment is required.

3.2 Preview and Purchase

Before paying anything, you receive a free watermarked preview of your portrait. There is no obligation to continue. You pay only if you decide to — and payment confirms your choice to receive your order, whether that is a final high-resolution digital file or a Canvas Print.

3.3 Digital Portrait Delivery

Once your payment is complete, your high-resolution digital portrait file is sent to your email address within minutes of completing your payment. Digital files are supplied in a standard image format suitable for personal printing and sharing.

3.4 Canvas Print Orders

Canvas prints are produced and shipped through our network of professional print partners located nearer to you — for faster delivery and consistent quality worldwide. Production takes 2–3 business days, with estimated delivery of 5–7 business days within the US and 7–20 business days internationally, depending on where you are. See our Shipping Policy for the full details. BeyondFrames Studio is not responsible for delays caused by third-party carriers or customs authorities.

3.5 Order Accuracy

It is your responsibility to review your preview carefully before completing your purchase. We cannot issue refunds for dissatisfaction with a portrait where the preview was reviewed and the purchase was completed.

4. CONTENT AND INTELLECTUAL PROPERTY

4.1 Your Uploaded Photos

You keep full ownership of any photographs you upload to our platform. By uploading, you grant BeyondFrames Studio a limited, non-exclusive license to use the image solely to create your commissioned portrait.

4.2 Third-Party Consent

By uploading a photograph that features other people, you confirm you have the right or permission to use and submit that image for portrait creation. BeyondFrames Studio is not responsible for any claims arising from the unauthorized use of another person's likeness.

4.3 Portrait Artwork Usage Rights

Once payment is complete, you own your delivered portrait and receive a worldwide, perpetual license for both personal and commercial use. That covers personal display, printing and sharing, as well as commercial use in marketing materials, merchandise, business branding, print-on-demand products, publications, and advertising — at no extra cost. 4.4 BeyondFrames Studio Intellectual Property

All branding, website design, technology, and creative processes used to produce portraits remain the exclusive property of BeyondFrames Studio. You may not reproduce, reverse-engineer, or redistribute our platform or processes.

4.5 Content Restrictions

You may not upload photographs that:

  • Infringe on anyone's intellectual property or privacy rights
  • Contain illegal, sexually explicit, or harmful material
  • Depict minors in any inappropriate or exploitative way
  • Break any applicable local, national, or international law

5. DIGITAL DOWNLOADS

5.1 File Delivery

Digital portrait files are sent to the email address given at the time of purchase. Please make sure your email address is correct before completing your order.

5.2 Re-download

If your file doesn't arrive or you run into a delivery problem, contact our support team and we will re-send your file at no extra charge.

5.3 Watermarked Previews

Watermarked previews are for review only and may not be used, shared, or printed as a final product. Full-resolution, watermark-free files are delivered only after payment is complete.

6. ACCEPTABLE USE

By using BeyondFrames Studio, you agree not to:

  • Attempt to access, copy, or extract any part of our portrait generation technology
  • Use automated tools to submit bulk or fraudulent orders
  • Misrepresent your identity or the ownership of any uploaded image
  • Resell or sublicense orders placed through our platform without authorization
  • Take any action that disrupts or overloads our systems

7. SERVICE AVAILABILITY

7.1 Uptime

We aim to keep BeyondFrames Studio available at all times, but we cannot guarantee uninterrupted service. Occasional downtime may happen due to maintenance, updates, or factors outside our control.

7.2 Scheduled Maintenance

We may carry out maintenance at any time, with or without advance notice, and will make reasonable efforts to keep any disruption to a minimum.

7.3 Service Changes

We reserve the right to modify, update, or discontinue any feature of our service at any time. For significant changes that may affect your experience, we will give reasonable notice.

8. PAYMENT AND BILLING

8.1 Payment Processing

All payments are processed securely through Shopify Payments. BeyondFrames Studio does not store your full card details.

8.2 Pricing

All prices are shown on our website and may change. The price that applies to your order is the one displayed at checkout.

8.3 Taxes

Prices may be subject to applicable local taxes. You are responsible for any taxes, duties, or customs fees linked to your order.

8.4 Failed Payments

If a payment fails, your order will not be fulfilled. Please make sure your payment information is correct, and contact our support team if you run into any payment issues.

9. REFUNDS AND RETURNS

Our refund and return policy is set out in full in our Refund Policy. In short:

  • Digital portrait files are non-refundable once delivered
  • Refunds may be available where there is a technical failure or an error on our part
  • Canvas Print problems (damaged or defective) are handled under our Refund Policy

10. PRIVACY

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal data — including the photographs you upload to our platform.

11. DISCLAIMERS

11.1 Service Provided As-Is

BeyondFrames Studio is provided on an "as is" basis. We make no warranties, express or implied, about the fitness of our service for any particular purpose.

11.2 Portrait Results

While we do everything we can to deliver high-quality portraits, artistic results may vary depending on the quality of the photograph submitted. Our free preview step exists to give you confidence before any payment is made.

11.3 Third-Party Services

We are not responsible for the performance or policies of the third-party services we use to run our platform, including payment processing and fulfillment partners. Their terms apply independently to their own services.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, BeyondFrames Studio and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:

  • Loss of data, revenue, or business opportunities
  • Dissatisfaction with portrait results where a preview was reviewed and the purchase was completed
  • Delays or losses caused by third-party shipping carriers
  • Any claim exceeding the amount paid for the specific order in question

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BeyondFrames Studio and its affiliates from any claims, damages, or costs — including legal fees — arising from your use of the service, your breach of these Terms, or your infringement of any third-party rights.

14. DISPUTE RESOLUTION

14.1 Informal Resolution First

Before starting any formal dispute process, please contact our support team at support@beyondframesstudio.com. Most issues can be sorted out quickly through direct communication.

14.2 Binding Arbitration

If a dispute cannot be settled informally, both parties agree to resolve it through binding arbitration under the rules of the American Arbitration Association, rather than through court proceedings.

14.3 Individual Claims Only

You agree to resolve any dispute with BeyondFrames Studio on an individual basis. You waive any right to take part in a class action or representative proceeding.

15. GOVERNING LAW

These Terms of Service are governed by and interpreted under the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes not resolved through arbitration are subject to the exclusive jurisdiction of courts located in Wyoming.

16. ACCOUNT SUSPENSION AND TERMINATION

16.1 Termination by BeyondFrames Studio

We reserve the right to suspend or permanently terminate any account that breaches these Terms, takes part in fraudulent activity, or poses a risk to other users or our platform.

16.2 Effect of Termination

On termination, your right to access and use the service ends immediately. Completed orders are unaffected, and delivered files remain yours to use under the terms of these agreements.

17. CHANGES TO THESE TERMS

We may update these Terms of Service at any time. When we make material changes, we will notify active users by email and post a notice on our website. Continuing to use BeyondFrames Studio after changes take effect means you accept the revised Terms.

19. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the smallest extent necessary. The remaining provisions stay in full force and effect.

20. ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy, Refund Policy, and Shipping Policy, make up the entire agreement between you and BeyondFrames Studio regarding the use of our service. They supersede all prior agreements or understandings on the same subject.

By using BeyondFrames Studio, you confirm that you have read, understood, and agree to be bound by these Terms of Service.
